These Terms of Use ("Terms") govern your access to and use of the TalentChoice website and platform ("the Platform") operated by TalentChoice (“we”, “us”, or “our”). By accessing or using the Platform, you agree to comply with and be legally bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.
1. Eligibility and User Types
You must be at least 18 years old and legally capable of entering into binding agreements to use the Platform. The Platform is designed for two primary user types:

Recruiters: Professionals who offer recruitment or talent placement services.

Employers: Individuals or businesses submitting job briefs or exploring recruiter options.
By using the Platform, you represent and warrant that all registration information is true and accurate, and you agree to maintain its accuracy.
2. Platform Purpose and Limitations
TalentChoice is a digital comparison and lead facilitation tool, not a recruitment agency, staffing firm, or employment intermediary. We do not:

Vet, endorse, or guarantee any recruiter or employer

Provide legal advice or verify employment contracts

Participate in any final hiring or placement negotiations
All business conducted between recruiters and employers is solely between those parties. We are not responsible for contract terms, outcomes, or performance.
3. Account Responsibilities
You are responsible for maintaining the confidentiality of your login credentials and restricting access to your account. You accept full responsibility for all activities that occur under your account.
You agree not to:

Misrepresent your identity or qualifications

Upload misleading or false information

Create duplicate or fraudulent recruiter profiles

Allow others to access your account without permission
We may, at our discretion, disable or terminate any account that violates these Terms.
4. Recruiter Use and Obligations
Recruiters agree to:

Maintain accurate and up-to-date profiles

Represent their services, pricing, and experience truthfully

Respond to leads professionally and in a timely manner

Comply with applicable employment laws, licensing, and data protection requirements
TalentChoice reserves the right to limit visibility, deactivate profiles, or remove content deemed misleading, noncompliant, or abusive.
5. Employer Use and Obligations
Employers agree that:

All job briefs are submitted in good faith and represent real hiring needs

TalentChoice may share submitted briefs with matched recruiters

They will not harvest recruiter contact details for unsolicited outreach or third-party use
Employers are solely responsible for screening, selecting, and engaging with recruiters. TalentChoice does not participate in any hiring, selection, or fee negotiation process.
6. Payments, Subscriptions, and Billing
Recruiter subscriptions are processed through secure third-party payment providers. By subscribing, recruiters agree to:

Recurring charges based on selected plans

Payment failures resulting in access restrictions

No refund obligations unless required by law
We reserve the right to modify pricing or plan features at any time with notice.
7. Content Ownership and Use
All recruiter-generated content (text, images, rates, testimonials, etc.) remains the property of the original contributor. However, by submitting content to the Platform, you grant TalentChoice a worldwide, royalty-free, perpetual license to use, display, modify, and publish such content for the purpose of providing and marketing our services.
All other site content — layout, branding, code, icons, and copy — remains the exclusive intellectual property of TalentChoice.
8. Disclaimers and Risk Allocation
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, we disclaim all warranties including:

Fitness for a particular purpose

Merchantability

Accuracy of recruiter or employer information

Continuous or error-free operation
We are not responsible for:

Misrepresentations or negligence by recruiters or employers

Missed job opportunities, delays, or hiring outcomes

Loss of data or platform downtime
9. Indemnity
You agree to fully indemnify, defend, and hold harmless TalentChoice, its affiliates, employees, officers, agents, and partners from any claim, liability, loss, expense, or demand — including legal fees — arising from:

Your use of the Platform

Any breach of these Terms

Any violation of laws or third-party rights in your use of the Platform

Any dispute or contract entered into with another user
This indemnity obligation survives termination of your account or use of the Platform.
10. Platform Availability and Technical Issues
We do not guarantee uninterrupted or secure access to the Platform. Technical issues, scheduled maintenance, or third-party failures may cause downtime. We are not liable for:

Platform outages or service disruptions

Loss of business, leads, or revenue due to technical issues

Inaccurate display or failure to update recruiter data in real-time
We may suspend access temporarily or permanently for system upgrades or emergencies.
11. Legal Jurisdiction and Dispute Resolution
These Terms are governed by the laws of Victoria, Australia. In the event of a dispute, the parties agree to seek resolution through informal negotiation first. If unresolved, disputes will be subject to binding arbitration or litigation in the courts of Victoria.
12. Modifications to These Terms
We may update these Terms at any time. All changes will be posted on this page with the updated effective date. Continued use of the Platform signifies acceptance of the revised Terms.

14. Entire Agreement and Severability
These Terms constitute the full agreement between you and TalentChoice. If any provision is found unenforceable, it will be severed, and the remainder of the Terms will remain in full force.
